Terms and Conditions
§ 1 Scope and provider
(1) These General Terms and Conditions apply to all orders you place through the online shop at rise-up.store.
(2) The provider and contracting party is RiseUp, owner Tristan Häseker, c/o Adressgeber #2175, An der Alten Ziegelei 38, 48157 Münster, Germany, email info@rise-up.store.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(4) Deviating terms of the customer do not become part of the contract unless we expressly agree to their application.
§ 2 Conclusion of contract
(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.
(2) By submitting your order via the „Zahlungspflichtig bestellen“ (order with obligation to pay) button, you make a binding offer.
(3) We confirm receipt of your order without undue delay by email. This confirmation of receipt does not yet constitute acceptance. The contract is concluded once we declare acceptance or dispatch the goods.
(4) We store the text of the contract. You receive the order data and these terms by email.
(5) The contract is concluded in German.
§ 3 Prices and shipping costs
(1) All prices are final prices. As a small business within the meaning of § 19 of the German VAT Act (UStG), we do not charge value added tax and therefore do not show it.
(2) Within Germany we ship free of charge. For deliveries to other EU countries and to Switzerland, the shipping costs are shown during the order process before you submit the order.
(3) For deliveries to Switzerland, customs duties, import VAT and a customs clearance fee charged by the carrier may apply. These are borne by the recipient and are not included in the purchase price.
§ 4 Payment
(1) The available payment methods are shown during the order process.
(2) The purchase price is due for payment upon conclusion of the contract.
§ 5 Delivery
(1) The goods are dispatched on the next business day after conclusion of the contract. Within Germany, delivery usually takes two to four business days from the order. For deliveries abroad, the delivery time is shown during the order process.
(2) We deliver to Germany, to the member states of the European Union and to Switzerland.
(3) If the ordered goods are not available, we will inform you without undue delay. Any payment already made will be refunded promptly.
§ 6 Retention of title
The goods remain our property until full payment has been made.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. The details are set out in the withdrawal policy, which, together with the model withdrawal form, is available at rise-up.store/pages/widerruf and is sent to you with the order confirmation.
§ 8 Liability for defects
(1) The statutory rules on liability for defects apply.
(2) For consumers, the limitation period for claims based on defects is two years from delivery of the goods. We neither exclude nor shorten the statutory liability for defects.
(3) We do not provide any voluntary guarantee beyond this. Your statutory rights remain unaffected.
(4) Please report defects to info@rise-up.store. We will get back to you promptly and agree the further procedure with you.
§ 9 Liability
(1) For damage arising from injury to life, body or health, as well as in cases of intent and gross negligence, we are liable without limitation in accordance with the statutory provisions.
(2) In the case of simple negligence, we are liable only for the breach of an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.
(3) Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
§ 10 Note on the product
The RiseUp Tag is an accessory to an alarm app. It is not a medical device and is not intended to ensure waking up in safety-critical situations. For appointments on which a lot depends, please do not rely on a single alarm source.
§ 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.
(2) Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
